This website www.fitberry.no (the "Webssite") is operated by FITBERRY AS - 926 765 574 (referred to as FITBERRY/we/our/us). These General Terms and Conditions apply to all use of the Website and the Webshop. FITBERRY reserves the right to change the terms and conditions from time to time. The current version of the General Terms and Conditions are those accessible on the Website. 

All content on the Website and the Webshop, including without limitation designs, text, illustrations, photographs, logos, images and film, are the intellectual property of FITBERRY or its content suppliers and all trademarks and/or company names mentioned, displayed or otherwise indicated on the Website are the property of their respective owners. The Website and Webshop and their content may only be used for personal, non-commercial, purposes.

Nothing contained on the Website or Webshop should be construed as granting, by implication, estoppel or otherwise, any license or right to use any material appearing on the Website, except to the extent permitted by mandatory law, without our prior written approval or the written approval of such third party that may own the rights to the material displayed on the Website.
The Webshop and its content are provided on an “as is” basis without any warranties of any kind, either express or implied, including with respect to fitness for a particular purpose and as to the Webshop’s operation or content. FITBERRY disclaims all warranties, expressed or implied, to the extent permitted by applicable laws. FITBERRY disclaims any and all liability for any and all damages arising from the use of or inability to use the Webshop.

Orders shall be placed on the Website. It is essential that you examine our confirmation of your order to ensure that it is correct. In case of error or if you wish to modify your order please contact us immediately. Due to Norwegian legislation we are obliged to demand written permission from a legal guardian when the customer is below 18 years of age.
By accepting the terms and conditions you agree to subscribe to our newsletter. You can at any time cancel the subscription by following the link available at the bottom of every e-mail.

All data shown on the product level, are data in connection with FITBERRY warehouse. When we receive new deliveries of a product to the warehouse or if a product is sold out, data might change.

PLEASE NOTE: We recommend ordering your pre-order garments separately to ready to ship garments. Orders from this release will not be partially dispatched. If your order includes both ready to ship & pre-ordered garments, this will be dispatched together following the pre-ordered timeline. 

Note: your order has not been dispatched until you receive an email from us with your tracking number. 

Pictures and images on the website are for illustration purposes only. Be aware that the colors of goods as shown on the website will depend on several factors, such as your display settings. You will find a description of product details and what is included with the product in the corresponding written description.
All goods are subject to availability and we may not be able to accept and supply your order. We reserve the right to withdraw any goods from sale at any time, and our only liability to you for withdrawing any goods will be to refund any money paid to us for such order, by crediting your credit card. If you have placed an order which we are not able to deliver and therefore cannot accept, we will make sure to contact you as soon as reasonably possible.

The Customer may pay for the purchase in the manner specified on the Website.

Questions regarding Klarna payment are referred to Klarna's app (https://app.klarna.com) and customer service (https://www.klarna.com/customer-service)

All prices listed on the website include a Norwegian value-added tax of 25%. Charges for toll and taxes might be charged by the authorities in the receiving country depending on the legislation in that country. Such charges shall be paid by the customer. FITBERRY cannot inform the customer about these charges and the customer is responsible for the administration for payment and the payment of such charges.

The prices stated in the webshop are valid as long as the goods are available or nothing else is stated on our website.

In the checkout, when proceeding to the payment, you can see what countries we ship to.

All prices are listed exclusive of freight charges. The freight charge is added to the price and shall be paid by the customer. The freight charge is announced when placing an order.

We only provide the information necessary about you to the companies involved in delivering your order, handling your payment and the transport to your home, for example, your telephone number in case there is any problem with delivering your order.

Our ambition is to send your order as soon as possible. 

All orders are shipped out within 3 - 5 Business Days of purchase from our warehouse in Norway. Processing time may be extended during holidays, launches/re-stocks, limited edition releases and promotions. We will do all we can to ensure your order is dispatched on time.
At the checkout you will see exactly what prices and delivery methods apply to your order.

Pre-order items: please refer to individual product descriptions for more information on estimated shipping.

Our goal is that you will be completely satisfied with the product or the products you purchase at FITBERRY. If you order from the website you have a right to regret your purchase within 14 days from receiving the product. We currently do not offer free return shipping. Returns are at the cost of the customer. We do not offer free exchange for customers outside Norway. If you wish to exchange your item, you must return the item and place a new order. 

We only accept return items according to the following guidelines:

  • Products must be returned within 14 days after the product is delivered.
  • The product must be packed neatly in its original packaging so that the product appears as new.
  • Products must be unworn and unwashed with all tags still attached.
  • Cannot have deodorant marks on item(s), stains of any kind (makeup/self-tanner, etc.), abnormal smell (perfume, body odor, etc.). 
  • We reserve the rights to refuse your refund if the items are not sent back to us in their original condition. In such a case we will organise to reship the goods back to the given shipping address.
  • Once received in the warehouse, returns will be processed within 5-7 business days and credited back to the original form of payment. You will receive an email confirmation when your return has been received, inspected and completed.
  • Please note any shipping charges incurred at the time of purchase are non-refundable.
  • We do not take responsibility for lost, misplaced, or incorrectly delivered shipments when returning products. Please contact the shipping courier for more information.

Please note that we reserve ourselves from products being sold out when you wish to change color or size. If this is the case, we will contact you through email. In case we don’t receive a response within 3 days, we will credit your order and you are more than welcome to make a new purchase. 

You can return your order within 14 days. Read more about the terms that apply on returns, changes and which address to send it to here.

If you choose to return one or more products at promotional purchases where a product was followed on the purchase, the free product should also be returned in unopened/original order. If you choose to keep the free product, we will send an invoice for the product's value.

You can not use multiple discounts at the same time. 

You can use a discount together with a gift certificate.

We must collect your personal information to fulfill the agreement. Personal information is considered any information that directly or indirectly can be connected to an individual. The information submitted at registration is registered and handled by FITBERRY. GDPR entitles you to request an extract of the information that is registered about you. If any information is incorrect, incomplete or deceptive we will of course correct it if you inform us. You can also request for having the information about you deleted. FITBERRY only uses the information to fulfill the agreement and does not sell personal information to any third party. By accepting these term and conditions you also accept that FITBERRY collects and handle your personal information. 

FITBERRY is conducting serious and ambitious work regarding security and continuously upgrading and updating our efforts to maintain this site a safe place for our customers. 
Any attempts to defraud, use false or stolen credit card data, access another person’s shopping account or similar attempts or other criminal misconduct will be reported to the police authorities. We are tracking IP addresses in order to use these in criminal investigations and proceedings.

If FITBERRY fails to comply with its obligations according to these General Terms and Conditions because of unusual adverse circumstances outside of its control due to Force Majeure, FITBERRY will not be responsible for the consequences. A Force Majeure is at the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events.

We do our best to make all our customers satisfied. We always try to satisfy you if something is wrong with your purchase. If we cannot settle we recommend you to file a complaint with The National Board for Consumer Complaints (Forbrukerrådet) for an independent examination. We always pursue with The National Board for Consumer Complaints recommendation.

The European Commission's complaints portal can also be used if you wish to lodge a complaint. This is especially relevant if you are a consumer residing in another EU country. The complaint is submitted here: http://ec.europa.eu/odr.
